Terms and Conditions for Viral Exclusive

1. Introduction

Welcome to Viral Exclusive (referred to as "we," "us," or "the Site"). Viral Exclusive is an online platform (landing page) that facilitates the sale of access links to digital content packs. Please note: Viral Exclusive is a trade name for our online service and is not a registered company or legal entity. By accessing our Site or purchasing any digital content link from us, you ("the user" or "the customer") agree to be bound by the following Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not use our Site or purchase our content links.

2. Description of Service

Viral Exclusive provides users with the ability to purchase a download link (for example, a link to a file on a third-party platform such as Google Drive) that grants access to a collection of digital content (referred to as the "Content"). When you complete a purchase through our Stripe payment gateway, you will receive an email containing a link through which you can access and download the Content you bought.

No Physical Product: We do not ship any physical goods. All products are digital in nature (accessed via a link).
Not an Official License Sale: You are not purchasing ownership of the Content or an official license to the Content. You are only purchasing a single-use access link that allows you to download or view the Content for your personal use.

3. Intellectual Property and Licensing Disclaimer

All Content accessed through the link provided by Viral Exclusive may be subject to intellectual property rights (such as copyright, trademark, etc.) held by third parties (the original creators or owners of that Content). By selling you an access link, we are not transferring or granting you any intellectual property license or rights in the Content.

Personal Use Only: Any Content you obtain via our service is for your personal, non-commercial use only. You may view, download, and use the Content only for personal purposes.
No Redistribution or Reuse: You cannot copy, distribute, share, resell, sublicense, rent, or exploit the Content in any way outside of your own personal use. This means you cannot upload it to other websites, use it in your own products/services, claim it as your own, or use it for any commercial benefit.
No Derivative Works: You cannot create derivative works (e.g., edits, compilations) from the Content for distribution or any purpose not covered under personal fair use.

Acknowledgment: You confirm that you understand what you are purchasing – an access link to digital content – and that you will act responsibly. Even if "everyone knows" the nature of this Content or its typical use, as a user you explicitly agree to abide by these Terms and use the Content only as permitted. Any attempt to bypass, break, or go beyond the intended use of the Content or the service will be considered a violation of these Terms.

5. Privacy and Data Protection

Data Retention: We will retain personal data only for as long as necessary to fulfill orders and comply with legal obligations. Unnecessary data will be deleted or anonymized.
Customer Data Confidentiality: We emphasize that we will not disclose customer data. Your identity and purchase details will be kept confidential by Viral Exclusive, except if we are legally compelled to disclose certain information (e.g., by a court order or government authority).

6. Payment and Refund Policy

All payments are processed through Stripe using a secure checkout. By purchasing a Content link, you agree to the pricing and payment terms that were presented to you at checkout.

Pricing: All prices are listed in U.S. Dollars (USD) unless stated otherwise. The price you pay is the price indicated at the time of purchase for the specific content pack or link. We reserve the right to change prices for any future offerings or new content packs, but no price change will affect an order you have already completed.
Payment Processing: Payments are handled by Stripe, a third-party payment processor. By making a purchase, you agree to Stripe’s terms and conditions as well. We are not responsible for any payment processing errors or issues on Stripe’s side.
No Withholding of Content: Once your payment is successfully completed, we will promptly deliver the access link to the email address you provided. Please ensure you input your email correctly; we are not responsible for non-delivery due to an incorrect email address.
Refund Policy: Due to the digital nature of the product (access to downloadable content), all sales are generally considered final. We do not offer refunds or returns once you have received the access link. By completing a purchase, you gain immediate access to valuable digital content, and it cannot be “returned.” We appreciate your understanding of this policy, as it is standard for digital goods.
- Exception: If for some reason the link you receive is completely non-functional, or you are unable to access the Content at all, please contact us as soon as possible. We will work with you to resolve the issue – for example, by providing a replacement link. In cases of genuine technical error on our part, at our discretion, we may issue a refund or alternate solution.
- We will not issue refunds in cases where the Content is accessible as intended, but you change your mind or decide you no longer want the product.
Chargebacks and Fraud: If we suspect that a purchase is fraudulent or that a customer has unlawfully shared their link or violated these Terms, we reserve the right to suspend or terminate access to the Content and, if necessary, refuse any future service to such customer. We also reserve the right to contest any unwarranted chargebacks.

7. Disclaimer of Warranties

Viral Exclusive provides the service and Content links on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, express or implied, regarding the service or the Content you access through us. This includes, but is not limited to:

Content Quality or Suitability: We do not guarantee that the Content will meet your expectations, be fit for a particular purpose, be accurate, complete, or free of errors. The Content is provided without any endorsements or warranties from us. Every buyer "knows what they are buying it for," and you accept the Content as it is provided.
Availability: We do not warrant that the download link or the Site will be available on an uninterrupted, secure, or error-free basis. There may be times when the hosting service (such as Google Drive or other third-party file host) is unavailable or the link is temporarily down. 8. Limitation of Liability

In jurisdictions that do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you. If you are dissatisfied with any aspect of our service, or with these Terms, your sole and exclusive remedy is to discontinue use of the service.

9. Indemnification

You agree to indemnify and hold harmless Viral Exclusive, its owner/operator, affiliates, agents, and employees from and against any and all claims, liabilities, losses, damages, obligations, costs or debt, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your violation of any term of these Terms and Conditions,
Your violation of any law or regulation or third-party right (such as an intellectual property right) in relation to your use of the Content,
Your misuse of the Content or use of the Content beyond personal purposes (for example, if a third party takes legal action because you distributed content without authorization, you agree that we are not responsible and that you will handle any such claim at your expense), or
Any other party’s access and use of the service with your unique link or account credentials (e.g., if you share your download link and someone else uses it in violation of these Terms, you are responsible for the consequences).

This indemnification obligation means you will defend, pay for, and reimburse (including covering legal fees) Viral Exclusive in case of claims or losses that result from your actions or misuse. We put this in place to protect ourselves (as we said, "we have to protect ourselves first and foremost") from liabilities that rightly belong to users who violate the rules or misuse the service.

10. Governing Law and Jurisdiction

These Terms and any disputes arising from or related to your use of the Site or purchase of Content shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of Viral Exclusive is based, without regard to its conflict of law principles. Currently, the operator of Viral Exclusive conducts operations from within the European Union (EU).

In the event of any dispute, claim, or controversy between the user and Viral Exclusive arising out of or relating to the use of our service or these Terms:

Jurisdiction: You agree that such disputes will be subject to the exclusive jurisdiction of the competent courts in the jurisdiction of our operation. (In plain terms, this means the courts that have authority in the country/region where we operate will handle any such dispute.) We reserve the right, however, to file or participate in legal proceedings in courts of your country/residence if the dispute calls for it, but the primary governing law will remain as stated above.
Waiver of Objections: You waive any objection to the venue or jurisdiction on the basis that it is inconvenient or not your home forum. By agreeing to these Terms, you knowingly agree to resolve disputes in the specified jurisdiction.

Note: Nothing in this section shall limit any rights you may have as a consumer under the mandatory laws of your country of residence. If you are a consumer and the laws of your country grant you certain protections or the right to resolve disputes in your home country, those may still apply despite what is written here. Our intention with this clause is to state a governing law for the agreement and a default forum for disputes, not to unlawfully deprive any party of protections given by applicable law.

11. Additional Provisions

No Personal Liability: These Terms regulate the relationship between you and the Viral Exclusive service. The individual owner/operator of Viral Exclusive has no personal liability to you beyond what is covered by these Terms. By using the service, you agree that you will not pursue any claims personally against the owner/operator for matters related to the service; any legal remedy will be sought against the service/business itself (to the extent it can be considered a separate entity).
No Waiver: If we do not enforce a part of these Terms at any time, it does not mean we give up the right to enforce it later. Any waiver of rights by us must be explicit and in writing.
Severability: If any provision of these Terms is found to be unlawful or unenforceable by a court of competent jurisdiction, that provision will be removed or limited to the minimum extent necessary, and the rest of the Terms will remain fully valid and enforceable.
Entire Agreement: These Terms constitute the entire agreement between you and Viral Exclusive regarding your use of our Site and service, superseding any prior understandings or agreements (whether oral or written) regarding the same subject matter. You acknowledge that you have not relied on any representation, promise, or statement not expressly set out in these Terms.
Changes to Terms: We reserve the right to modify or update these Terms at any time. If we make material changes, we will provide notice by updating the Terms on our website (and changing the "Last updated" date). It is your responsibility to review the Terms periodically.
